favour
The new approach to rescuing rather
than liquidating businesses has been encouraged by the
government at a high level, with the new Minister of
Justice, Brigitte Mabandla, setting the tone by saying that
"the emphasis must be on rescuing rather than liquidating
business entities in order to protect the economy, workers
and their families, and creditors".

Liquidators Win Major Battle
The liquidators of Consolidated News Agencies (Pty) Ltd (in
liquidation) (“Consolidated”) won a major battle in the
Transvaal Provincial Division of the High Court when they
succeeded in having ABSA’s claim of R133 336 454,72 which
they proved against Central News Agencies, expunged in the
recent case of Consolidated News Agencies (Pty) Ltd (in
liquidation) and Others v ABSA Bank Ltd and Others.

New owners bullish about Karoo Mineral Water
It was originally suggested the company could be sold for
about R1,7m. Hans
Klopper said that there was considerable interest from
the industry and the liquidators managed to secure the
possible offer of R2,3m, including stock. This was an
example of a successful business rescue. Karoo had
unsubordinated debts of about R9m so the proceeds from the
sale will help to pay creditors.

Consolidated News Agency in the two weeks before the company

The spat appears to be
rooted in an alleged sale by liquidators Hans Klopper and
Jan Reitz of two intellectual property assets to Edcon,
which was the main buyer (in October 2002) of assets out of
the liquidated stationer, CNA. In the latest Edcon annual
report, to March 31, 2003, Ross says Evans was able to
“negotiate three tough deals [during the financial year] and
deliver two important components of our future growth, CNA
and Super Mart.”
